The short version. We collect only what you choose to send us, mainly your name, email address and project details, so we can reply and prepare a quote. We do not sell your personal data, we do not use it for targeted advertising, and this website runs no analytics, advertising or third-party tracking scripts.
1. Introduction and Scope
This Privacy Policy explains how Patrick Martin Exclusive ("we," "us" or "our") collects, uses, shares and protects personal data when you visit this website, submit a quote request, email us or otherwise interact with us (together, the "Site"). Patrick Martin Exclusive is the controller of the personal data described in this policy. Personal data that we process on behalf of clients inside licensed software, agents or custom applications is governed by the agreement with that client and, where applicable, a data processing addendum.
2. Information We Collect
Information you provide
- Contact details such as your name, email address, phone number, company name and state.
- Request details such as the service you are interested in, your trading experience, whether you have a brokerage account, team size, the tools you use, your budget range, timeline and any description of your idea.
- Correspondence including emails and attachments you send us.
- Client records if you become a client, such as signed agreements, billing contacts and support history.
Please do not send us passwords, API keys, brokerage account numbers, account balances, Social Security numbers, payment card numbers or health information. We do not need them to prepare a quote.
Information collected automatically
- Server logs. Like most websites, the company that hosts this Site may automatically record technical information such as your IP address, browser type, the pages requested and the date and time of each request, for security and operational purposes.
- Browser storage. The Site stores one essential item in your browser to remember your cookie choice. See our Cookie Policy.
The Site does not use analytics tools, advertising pixels, social-media plugins, session recording or third-party fonts or scripts.
3. How the Inquiry Form Works
The inquiry form does not store your answers on our servers. When you submit it, your browser prepares an email message containing your answers, addressed to p.martin.exclusive@gmail.com, and opens it in your own email application (or, if you choose, in Gmail in a new tab). The message is sent only when you press Send. It is then transmitted by your email provider and received in our business mailbox, which is hosted by our email provider. Both providers process the message under their own privacy policies. If we later connect the form to a form-delivery service, we will update this policy to name that provider before it is used.
4. How We Use Information
- To respond to your inquiry, ask clarifying questions and prepare a quote.
- To negotiate, enter into and perform agreements with clients, including onboarding, support and billing.
- To send service-related communications, such as replies, quotes, updates and notices about our policies.
- To send marketing emails only if you have asked to receive them or are an existing client, with an easy way to unsubscribe.
- To protect the security and integrity of the Site, prevent fraud and enforce our Terms.
- To comply with legal, tax, accounting and regulatory obligations.
We do not use your personal data for profiling that produces legal or similarly significant effects, and we do not make decisions about you solely by automated means.
5. How We Share Information
We share personal data only as follows:
- Service providers (processors) who help us operate, such as our email provider, website host and, for clients, payment processors and accounting tools. They may use personal data only to provide services to us.
- Professional advisers such as attorneys, accountants and insurers, under confidentiality obligations.
- Legal and safety reasons when we believe disclosure is required by law, subpoena or court order, or is necessary to protect the rights, property or safety of Patrick Martin Exclusive, our clients or others.
- Business transfers in connection with a merger, acquisition, financing or sale of assets, subject to this policy's protections.
- With your consent or at your direction.
6. Sale of Personal Data, Targeted Advertising and Profiling
Patrick Martin Exclusive does not sell personal data, and has not done so in the past twelve months. We do not process personal data for targeted advertising, and we do not engage in profiling in furtherance of decisions that produce legal or similarly significant effects. We do not sell sensitive personal data or biometric data.
7. Sensitive Data
We do not intentionally collect sensitive data, such as data revealing racial or ethnic origin, religious beliefs, mental or physical health, sexual orientation, citizenship or immigration status, genetic or biometric data, precise geolocation, or data from a known child. If you include sensitive data in a message, we will use it only to respond to you, and you may ask us to delete it. We will not process sensitive data without your consent where consent is required by law.
8. Cookies and Similar Technologies
We use only essential browser storage. We honor Global Privacy Control (GPC) signals as a valid request to opt out of any optional cookies and of any sale of personal data or targeted advertising, should we ever engage in them. Full details are in our Cookie Policy. Because we do not track visitors across websites, we do not respond differently to "Do Not Track" browser signals.
9. Data Retention
We keep personal data only as long as needed for the purposes in this policy:
- Inquiries that do not become engagements: up to 24 months after our last communication, then deleted.
- Client records, agreements and invoices: for the term of the engagement and up to seven (7) years afterward to meet tax, accounting and legal obligations.
- Data subject to a legal hold or dispute: until the matter is resolved.
10. Data Security
We use reasonable administrative, technical and physical safeguards appropriate to the nature of the data, including encrypted connections, access controls on our accounts and limiting access to those who need it. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Email is not a secure channel for sensitive information.
11. Your Texas Privacy Rights
If you are a Texas resident, the Texas Data Privacy and Security Act (Texas Business and Commerce Code, Chapter 541) gives you rights regarding your personal data. Whether or not that law applies to us in a given case, we extend the following rights to Texas residents:
- Confirm and access: to confirm whether we process your personal data and to access it.
- Correct: to correct inaccuracies, taking into account the nature of the data and the purposes of processing.
- Delete: to delete personal data you provided to us or that we obtained about you.
- Portability: to obtain a copy of personal data you previously provided to us, in a portable and, to the extent technically feasible, readily usable format.
- Opt out: of the processing of your personal data for targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects. We do not engage in these activities.
We will not discriminate against you for exercising any of these rights, for example by denying services or charging different prices.
12. How to Exercise Your Rights and Appeal
- Submit a request by emailing p.martin.exclusive@gmail.com with the subject line "Privacy Request" and the right you wish to exercise. We will need to verify your identity, usually by confirming control of the email address associated with your data. We will not ask you to create an account.
- Authorized agents. You may designate an authorized agent to submit an opt-out request on your behalf. We may ask for proof of the agent's authority.
- Timing and cost. We will respond within 45 days of receipt. If reasonably necessary, we may extend that period once by an additional 45 days and will tell you why. Requests are free of charge up to twice in any twelve-month period; we may decline or charge a reasonable fee for requests that are manifestly unfounded, excessive or repetitive, as the law permits.
- Appeals. If we decline to act on your request, you may appeal by replying to our decision with the subject line "Privacy Appeal" within a reasonable time. We will respond in writing within 60 days, explaining any action taken or not taken and why. If your appeal is denied, you may contact the Office of the Texas Attorney General to submit a complaint at texasattorneygeneral.gov/consumer-protection.
13. Residents of Other States
Residents of other U.S. states, including California, Colorado, Connecticut, Virginia and others with comprehensive privacy laws, may have similar rights to access, correct, delete and port personal data and to opt out of certain processing. You may exercise those rights using the process above, and we will honor them as required by the law of your state. We do not sell or share personal data for cross-context behavioral advertising, as those terms are defined under California law.
14. Children's Privacy
The Site is intended for adults and is not directed to children. We do not knowingly collect personal data from children under 13, consistent with the Children's Online Privacy Protection Act, and our products are offered only to individuals 18 or older. If you believe a child has sent us personal data, contact us and we will delete it.
15. Email Communications
Commercial emails we send will comply with the federal CAN-SPAM Act: they will identify us, will not use misleading subject lines, and will include a working way to unsubscribe that we honor promptly. You cannot opt out of essential service messages about an active engagement.
16. Data Breach Notification
If a breach of system security affects your sensitive personal information, we will notify you and, where required, the Texas Attorney General and other authorities, in the manner and timeframes required by applicable law, including Texas Business and Commerce Code, Chapter 521.
17. Where Data Is Processed
Patrick Martin Exclusive is based in the United States, and our service providers process data in the United States. If you contact us from outside the United States, your data will be transferred to and processed in the United States.
18. Changes to This Policy
We may update this policy from time to time. The "Last updated" date shows when it last changed. If we make material changes, such as using personal data for a new purpose, we will post the updated policy here before the change takes effect and, where required, ask for your consent.
19. Contact
Questions or requests about this policy or your personal data can be sent to p.martin.exclusive@gmail.com with the subject line "Privacy."
